TERMS & CONDITIONS

  1. PROMOTER
    1. The Promoter is Care Pharmaceuticals Pty Ltd (ABN: 30 009 200 604) of Suite 302, Level 359-75 Grafton St, Bondi Junction, NSW 2022 (“Promoter”).
    2. Entry into the Rehydrate with Hydralyte $10 Cashback offer (“Offer”) is deemed acceptanceof these Terms and Conditions. Information on how to be eligible for the $10 Cashback (“$10Cashback”) as part of this Offer form part of these Terms and Conditions. All Eligible Entriesreceived prior to the end of the Redemption Period (defined below) will be eligible for the $10Cashback. The $10 Cashback will be delivered to the Eligible Entrant (defined below) with anEligible Entry in the form of a digital visa card.
    3. If there is any inconsistency between these Terms and Conditions and any other document orrepresentation that refers to the Offer, these Terms and Conditions will prevail.
  2. WHO CAN ENTER
    1. Participation in the Offer is only open to Australian residents aged 18 years or older, excluding:
      1. employees, management, directors, contractors and subcontractors of the Promoter,the Promoter’s related entities, and other agencies, firms or companies associatedwith the Offer;
      2. a spouse, de facto spouse, ex-spouse, parent, guardian, child or sibling of a personreferred to in subclause 2.1(a);
      3. persons who have breached the terms and conditions of any promotion or Offer run byor on behalf of the Promoter,(“Eligible Entrant”).
    2. The persons referred to in subclause 2.1(b) includes natural and non-natural relations (in theopinion of the Promoter) and the Promoter is responsible for determining whether a person isan Eligible Entrant in its absolute discretion.
    3. The Promoter reserves the right, at any time, to verify the validity of claims and EligibleEntrants (including an Eligible Entrant’s identity, age, place of residence at the nominated giftdelivery address and proof of purchase) and to disqualify any Eligible Entrant who thePromoter reasonably believes has submitted a claim that is not in accordance with theseTerms and Conditions or who tampers with the claim process in any way.
    4. Any entry that is made on behalf of an Eligible Entrant by a third party will be invalid, unlessthe Eligible Entrant requires the assistance of a third party to enter due to a disability.
  3. WHEN TO ENTER
    1. An Eligible Entrant must purchase the Relevant Products (defined below) between the period30 January 2025 to 12 February 2025 (“Purchase Period”).
    2. Entries must be received by the Promoter by no later 26 February 2025 (being two weeks afterthe end of the Purchase Period) (“Redemption Period”).
    3. If for any reason an Eligible Entrant does not redeem the $10 Cashback before theRedemption Period, the $10 Cashback will be forfeited by the Eligible Entrant.
  4. HOW TO ENTER
    1. Eligible Entrants must do all of the following before the end of the Redemption Period:
      1. Purchase any of the following Hydralyte® products during the Purchase Period from a Participating Store (“Relevant Products”):
        1. Hydralyte® 60 Tablets Peach Crush;
        2. Hydralyte® 60 Tablets Apple Blackcurrant;
        3. Hydralyte® 60 Tablets Strawberry Kiwi;
        4. Hydralyte® 60 Tablets Orange;
        5. Hydralyte® 60 Tablets Watermelon Burst; and
        6. Hydralyte® 60 Tablets Multi Flavour;
      2. Scan QR code or visit www.rehydratewithhydralyte.com.au and complete the onlineclaim form; and
      3. Upload a copy of receipt showing proof of purchase during the Purchase Period,(“Eligible Entry”).
      “Participating Store” means a participating Chemist Warehouse store in Australia thatdisplays the details of this Offer in its store.
    2. Incomplete, indecipherable, fraudulent or illegible entries will be deemed invalid.
    3. Eligible Entrants must retain the original receipt to verify their submission.
    4. The Promoter accepts no responsibility for any late, lost or misdirected entries not received bythe Promoter, or delays in the delivery of the entry due to technical disruptions, networkcongestion or for any other reason.
    5. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, inits absolute and sole discretion, to determine the identity of the Eligible Entrant.
    6. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoterto enforce any of its rights at any stage does not constitute a waiver of those rights. ThePromoter's legal rights to recover damages or other compensation from such an offender arereserved.
    7. Entrants will be responsible for any and all expenses incurred in claiming the $10 Cashback.
  5. DISQUALIFICATION
    1. The Promoter reserves the right, at any time and in its absolute and sole discretion, todisqualify any Eligible Entrant who the Promoter has reason to believe has breached any ofthese Terms and Conditions, tampered or interfered with the Offer in any way (including butnot limited to the entry process), who submits an entry that is not in accordance with theseTerms and Conditions or who has, in the opinion of Promoter, engaged in conduct in enteringthe Offer which is fraudulent, misleading, deceptive or generally damaging to the goodwill orreputation of the Offer and/or Promoter and/or Promoter’s supplier(s), or engaged in anyunlawful or other improper misconduct calculated to jeopardise fair and proper conduct of theOffer.
    2. The Promoter’s legal rights to recover damages or other compensation from such an offenderare reserved.
  6. NUMBER OF ENTRIES PERMITTED
    1. Only one Eligible Entry can be made per household.
    2. All Eligible Entries submitted to the Promoter prior to the end of the Redemption Periodexpiring will be eligible for the $10 Cashback.
    3. The $10 Cashback will be delivered to all [Eligible Entrants (each having submitted an EligibleEntry) in the form of a digital visa card which will be sent to the email address entered by theEligible Entrant on the online claim form and/or available for download by the Eligible Entrantinto their mobile wallets once the claim has been verified by the Promoter.
  7. PERSONAL INFORMATION
    1. All information Eligible Entrants provide (“Personal Information”) will be used by thePromoter and/or the Promoter’s supplier(s) for the purpose of administering or conducting theOffer and contacting and verifying Eligible Entrants. Details from entries will be collected andused for the purpose of conducting the Offer (which may include disclosure to third parties,contractors and agents, including local lottery authorities, for the purpose of processing andconducting the Offer) and for promotional purposes surrounding the Offer.
    2. By entering into the Offer, Eligible Entrants consent to the use of their Personal Information asdescribed and agree that the Promoter may use this information or disclose it to otherorganisations (including overseas organisations) and cannot guarantee that any overseasrecipient will not breach the Privacy Act 1988 (Cth) and Australian Privacy Principles (“APPs”).By entering the Offer, entrants consent to the overseas transfer on these terms as permittedby the Australian Privacy Principles and agree that the Promoter is not liable in this regard Inaddition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may,for an indefinite period, unless otherwise advised, use the Personal Information forpromotional, marketing, publicity, research and profiling purposes, including sending electronicmessages or telephoning the entrant. Entry into the Offer is conditional upon provision of therequested Personal Information.
    3. The Promoter will use and handle Personal Information as set out in its Privacy Policy, whichcan be viewed at https://hydralyte.com.au/privacy-policy/. The Privacy Policy details how aprivacy complaints can be made. The Privacy Policy also contains information about howEligible Entrants may opt out, access, update or correct their Personal Information and howcomplaints will be dealt with.
  8. EXCLUSION OF LIABILITY
    1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROMOTER, THE PROMOTER’SRELATED ENTITIES AND ALL AGENCIES ASSOCIATED WITH THE OFFER AND ITSEMPLOYEES, AGENTS, DIRECTORS AND CONTRACTORS SHALL NOT BE LIABLE FORANY LOSS OR CLAIM, ACTION, DEMAND, LIABILITY, DAMAGE, COST, EXPENSE ORPERSONAL INJURY WHATSOEVER INCLUDING BUT NOT LIMITED TO ANY DIRECT ORINDIRECT LOSS, COSTS, DAMAGES OR EXPENSES, INCLUDING CONSEQUENTIALLOSS, COSTS, DAMAGES OR EXPENSES, INCURRED, SUFFERED OR SUSTAINED BYANY PERSON OR ENTITY (WITHOUT LIMITATION) IN CONNECTION WITH, OR ARISINGFROM, THE OFFER OR THE ACCEPTANCE OR USE OF THE $10 CASHBACK.
  9. PROMOTIONAL ACTIVITIES
    1. The Eligible Entrant must, at the Promoter’s request, participate in any promotional activity(such as publicity and photography) relating to the participation in the Offer, free of charge,and consent to the Promoter using their name and image in any future promotional material inany media for an unlimited period of time for the purpose of promoting the Offer and/orpromoting any products manufactured, distributed or supplied by the Promoter.
    2. To the extent applicable, each Eligible Entrant hereby assigns to the Promoter all right, titleand interest in and to all intellectual property, copyright and all moral rights in any materialcreated or otherwise submitted to the Promoter in connection with that entrant’s participationin the Offer (“Works”). Each Eligible Entrant warrants that the Promoter is free to use theWorks (including modifying, adapting or publishing the entry, whether in original or modifiedform, in whole or in part or not at all) and to exercise its rights in relation thereto and neitherthe Eligible Entrant nor any third party will be entitled to any fee for such use.
    3. To the extent applicable, the Eligible Entrant hereby permits the Eligible Entrant’s submission,image and/or voice, as recorded, photographed or filmed during the Eligible Entrant’sparticipation in the Offer to appear in connection with the Hydralyte® brand or the advertisingor marketing thereof, in any media whatsoever throughout the world and the Eligible Entrantwill not be entitled to any fee for such use.
  10. GENERAL TERMS
    1. All submissions become the property of the Promoter.
    2. An Eligible Entrant is responsible for ensuring their familiarity with these Terms andConditions.
    3. Promoter may terminate or suspend the Offer and $10 Cashback at any time without anyrecourse or compensation to an Eligible Entrant.
    4. Any costs associated with claiming the $10 Cashback are the Eligible Entrant’s soleresponsibility and are solely dependent on the internet service provider used.
    5. The Promoter is not responsible for technical difficulties with the entry mechanism, includingwebsite malfunctions or glitches, and does not warrant that the entry mechanism will beavailable at all times.
    6. The Promoter shall not be liable for the any component of the $10 Cashback being lost,stolen, damaged or tampered with in any way before it reaches the Eligible Entrant or after ithas been released to the Eligible Entrant. The Promoter reserves the right to change, modify,remove or replace any of the Relevant Products at any time.
    7. Any attempt to deliberately undermine the legitimate operation of this Offer may be a violationof criminal and civil laws and should such an attempt be made, whether successful or not, thePromoter reserves the right to seek damages to the fullest extent permitted by law.
    8. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, excludeor modify the statutory consumer guarantees provided in the Competition and Consumer Act2010 (Cth).
    9. Eligible Entrants acknowledge that the Promoter can rely on these Terms and Conditions evenif the Promoter only learns of a person’s ineligibility after the Promoter has awarded the $10Cashback to the ineligible person. Repayment of the $10 Cashback (or any component of the$10 Cashback) to the Promoter may be required by the Promoter in such circumstances.
    10. These Terms and Conditions are governed by the laws of New South Wales, and the partiessubmit their disputes to the exclusive jurisdiction of the courts of New South Wales and anycourt hearing appeals from those courts.
    11. If an Eligible Entrant uses any form of software or third-party application to enter multiple times(including scripting software), organises for a third party to enter on their behalf in breach ofthese terms and conditions or enters using incorrect contact details, his or her entry will bedeemed invalid. If such an Eligible Entrant receives a $10 Cashback, the Eligible Entrant mustimmediately return the $10 Cashback to the Promoter. The Promoter has absolute and solediscretion to determine whether an Eligible Entrant has breached this clause. The Promoterreserves the right to request whatever documentation it deems necessary to confirm whetheran Eligible Entrant has breached this clause. Eligible Entrants must provide whateverdocuments the Promoter requires upon request or otherwise be disqualified from receiving the$10 Cashback.
    12. In the case of the intervention of any outside act, agent or event which prevents or significantlyhinders the Promoter’s ability to proceed with the Offer on the dates and/or in the mannerdescribed in these Terms and Conditions, including but not limited to vandalism, powerfailures, tempests, natural disasters, pandemic (including COVID-19), acts of God, civil unrest,strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Offer andrecommence it from the start on the same conditions, subject to any directions given understate or territory regulation.
